NSI PRIVACY POLICY

Introduction

Partners in Professional Learning & Development Pty Ltd [NSI Partnerships, ABN 30 620 191 353], IT Policy and Procedure Manual provides the policies and procedures for selection and use of IT within the business which must be followed by all staff. It also provides guidelines NSI Partnerships will use to administer these policies, with the correct procedure to follow.

NSI Partnerships will keep all IT policies current and relevant. Therefore, from time to time it will be necessary to modify and amend some sections of the policies and procedures, or to add new procedures.

Any suggestions, recommendations or feedback on the policies and procedures specified in this manual are welcome.

These policies and procedures apply to all employees.

Changes to our privacy policy.

From time to time, this Privacy Policy may be amended:

  • If our practices change
  • To account for changes in applicable laws and regulations.

If we change our privacy policy, we will notify you by email and post a notice on our service (e.g., at the start of our surveys). Following these notifications, continued use of our services will indicate that you agree to the new Privacy Policy.

Who does NSI collect information from?

NSI collects information from individuals who create accounts on our website (www.esischools.com), including teachers, administrators and school leaders. We also collect limited information from those responding to our surveys (students, parents, and school staff).

Who can view my feedback report?

Classroom level reports:

Individual teachers who administer a classroom-level questionnaire will receive a feedback package based on the responses to the questionnaire. We will not grant access to the report to anyone else without an express written request from the individual teacher. The data may be used for whole-school level reports only if:

  • there are more than four participants, and
  • all names and identifying markers are removed from the data.

Unless express permission is provided, neither the school nor any individual will be directly or indirectly identified in any publications.

Whole-school level reports:

Whole-school level reports will be emailed directly to the principal of the school. It is at the principal’s discretion as to who they share the feedback with. We will not release the reports to any other person without a written request from the principal.

Whole-school level reports may be used for research purposes. All schools will be de-identified unless otherwise agreed. Unless express permission is provided, neither the school nor any individual will be directly or indirectly identified in any publications.

What kinds of personal information do we collect and how?

The personal information we collect depends on your relationship with us – whether you are a client, a candidate or a prospective employee – and the product or service we deliver. It may include:

  • Your contact details and personal preferences (such as name, address, email address, phone number and dietary requirements),
  • Your website registration and login information,
  • Your payment details (if accessing our products or services as an individual),
  • Your employment history and qualifications,
  • Government-related identifiers and information (such as student number, working with children details and police checks),
  • Your testimonials, feedback and complaints.

Sometimes, we may also collect sensitive information about you. This may happen, for example, through surveys we administer, and may include your race and religious beliefs and your health information (such as whether you have any disability). We will only collect sensitive information from or about you with your consent unless otherwise required or authorised by law.

By supplying sensitive information about yourself or on behalf of your child, you will be taken to have given your consent to our collection of that information. When we obtain such information from a third party (such as through a school or institution at which you or your child studies), we will usually enlist that third party to obtain consent from you if required.

What is our approach to collecting personal information about children?

We collect information about children who, for example, respond to our surveys at the schools to whom we provide our services or participate in other research projects. Whether a child has the capacity to make their own privacy decisions is assessed by us on a case-by-case basis, with regard to factors such as their age and circumstances. In general, a person over 15 years can make his or her own privacy decisions.

For children under 15 years old, or who otherwise do not have the capacity to make these decisions for themselves, or where we cannot assess their ability, NSI will assume that the schools have organised the relevant consent.

When do we collect your personal information?

We may collect your personal information when you contact us, purchase or use our products or services (including when you participate in a survey or other research), register with us online, participate in our online discussion boards, contribute to one of our social media pages (such as Twitter, LinkedIn, Vimeo and Facebook), attend an NSI event, apply for a job with us or provide services to us.

Why do we collect the information and how do we use or disclose it?

We collect, hold, use and disclose your personal information for the following purposes.

  • To deliver our educational research and learning products and services (including our consultancy services and professional development programs).
  • To publish educational material.
  • To conduct our retail activities (including through our website).
  • To develop and enhance our products and services.
  • To conduct research and plan and develop our products.
  • To provide and operate our events and promotions.
  • To market and promote our products and services.
  • To comply with our legal

Can you choose to remain anonymous?

You may elect not to identify yourself or use a pseudonym in your dealings with us, except where it is impracticable for us to deal with you on this basis (for example, we will need to identify you to provide most of our products and services). You can always choose not to give us your information or remain anonymous, but if you do, we may not be able to provide you (or our client) with the products and services that you (or they) have asked for.

How can you request not to receive direct marketing?

You may ask us at any time to stop sending you direct marketing information or to stop being contacted by us or on our behalf, in a particular way or at all. You can do this by contacting us via our website.

Who do we disclose your personal information to?

We may disclose your personal information (including, in certain limited circumstances, your sensitive information), as outlined below.

  • To schools, educational institutions, psychologists, HR practitioners and other third parties who have contracted with us to provide our products or services.
  • To entities who assist us in providing and administering our products and our events and promotions (including hosting, data storage, payment systems, printing and scanning providers and debt collectors).
  • To companies that promote and market or conduct research to help us improve and target our products and services.
  • To social media sites on which we have a presence.
  • Where we are required to do so by law, or to government agencies, or individuals appointed by the government, responsible for investigating and resolving disputes or complaints concerning our products or services.
  • When you participate in a sponsored event, we may seek consent to pass your information to a promoter or sponsor of the competition or event as a condition of entry. If we do this, we will notify you when we invite you to the event or before entering the venue.

Do we disclose your information overseas?

We may disclose personal information to these bodies.

  • To our related bodies corporate located overseas to assist us in delivering our products and services; and,
  • To overseas educational institutions (including schools and universities) and other organisations or bodies (including government agencies) who are our clients and to whom we must provide your personal information to deliver our products and

How do we hold your personal information and keep it secure?

We hold your personal information in electronic and hard-copy files. We may store your personal information with one or more third-party data storage providers.

We may combine personal information we receive about you with other information we hold about you. This includes information obtained from third parties. In all cases, we will de-identify personal information collected from studies we carry out as part of our research activities (unless express permission is given not to do so).

We take all reasonable steps to ensure that the personal information we hold is protected from misuse, interference and loss, and unauthorised access, modification or disclosure by using various methods, including password protection and secure storage. Where we store your personal information with a third-party data storage provider, we require them to keep it secure and only use or disclose it for the purpose for which it was provided.

How can you seek access to and correction of your information?

You may request access to your personal information by writing to us or contacting us at any time using the details below. We will need to verify your identity before we can give you access. We will promptly acknowledge receipt and endeavour to deal with and respond to your request within a reasonable time (usually within two weeks).

In certain circumstances, we are permitted by law to refuse access to your personal information (such as where providing access would have an unreasonable impact on the privacy of other individuals or would reveal commercially sensitive information).

In such cases, we will give you a written explanation for our decision (including, where applicable, an alternative means of access to the information, such as supervised inspection) and how you can complain if you are not satisfied with our decision.

If you think any personal information we hold about you is inaccurate, incomplete, out-of-date, or irrelevant, you may ask us to correct it. Privacy Policy for Young People

At NSI, our company, we take the privacy of students seriously.

This Privacy Policy makes clear how we manage the personal information you give us, including how we collect it, where we store it, how we use it and who we share it with. It also shows how you can complain when your privacy has been broken.

Our privacy practices are in line with the Privacy Act 1988 (Cth).

Changes to our privacy policy.

This Privacy Policy may be changed if:

  • What we do changes.
  • If there are changes in a law that affects the policy.

If we change our privacy policy, we will let you know. Depending on what information we are collecting, we will tell you verbally and by email or with a notice that appears before you respond to another survey. If you keep using our products or surveys after we tell you about the changes, this indicates you agree to the new Privacy Policy.

Who does NSI collect information from?

Your teachers want to find out what you think about your school or class to make it even better for you. To do this, you will be asked to answer questions in a survey. These surveys collect personal information from people who respond to them, including students.

Sometimes, we do research in schools. During the study, we may collect personal information from the people involved, such as school staff, students and their parents.

Who can view my personal information?

Your information will only be seen by people who work at NSI. Any personal information you give us will not be shared, except as part of an average of the responses in a class or school. That is, we do not identify students, parents or school staff.

So that individuals cannot be identified, we will never provide your feedback to anyone unless there are more than four people who respond. When you respond to our surveys, you do not have to give us your name, so they are completely anonymous.

NSI staff are bound by a Code of Ethics, which means we must follow strict rules about what we are allowed to do.

What kinds of personal information do we collect and how?

The personal information we collect depends on whether you are part of the research or the survey you are responding to. The type of personal information we collect includes:

  • Your gender
  • Where you were born
  • Whether English is your first language
  • Whether you identify as Aboriginal or Torres Strait Islander
  • Your feedback and complaints.

We will only collect sensitive information from or about you if you let us know it is okay.

What is our approach to collecting personal information about young people?

The information we collect about young people depends on whether they can make a decision about their privacy. We make this decision based on things like the person’s age or circumstance.

In general, we feel young people over 15 can make their own privacy decisions.

We ask the schools to ensure a parent or carer gives their permission for people under 15 years old or who cannot make these decisions.

When do we collect your personal information?

We may collect your personal information when you are involved in our research or answer questions in a survey.

Why do we collect the information and how do we use or disclose it?

We collect your information to:

  • Give feedback to the schools about how they are doing.
  • Help us with our research.
  • Develop professional learning for teachers.
  • Publish journal articles.

We hold your data because the law requires us to.

Can you choose to remain anonymous?

You may choose not to tell us who you are (stay anonymous), or you can use a made-up name. You can always choose not to give us your information or remain anonymous.

How can you ask us not to send direct marketing?

We do not contact or send marketing to students. If you receive any direct marketing (advertising) information, you can let us know by visiting our website: www.nsipartnerships.com.au.

Who do we share your personal information with?

Most of your personal information is anonymous. However, in some cases, your personal information is shared with:

  • Schools and professionals who help us with our services.
  • Companies who help us to run our surveys and services (such as servers where data is stored and people who provide printing, scanning and data entry services).
  • Companies that help us improve our products and
  • People who ask us to do so by law, such as government agencies investigating a complaint about what we do.

When you come to an NSI event, if you are over 15, we may ask your permission to give your information to the person organising the event as part of the condition entry. We will let you know when we invite you to the event if we are going to do this.

Do we share your information overseas?

The only time we would share your information overseas is to:

  • companies connected to us that help us deliver our products and services; and,
  • make sure our products and services work.

How do we keep your personal information secure?

We hold your personal information in electronic files. We may store your information with data storage providers outside of NSI.

We may combine personal information we receive about you with other information we hold about you. This includes information from other companies. With all our data, we remove any information that can identify you. For example, once we combine the information, we remove your name, so no one knows it is yours.

We try our best to ensure that your personal information is protected. We use different ways, such as passwords and locked storage. When we store data with a provider outside of NSI, we ensure they are reputable and keep it secure.

How can you get your information or correct it?

You may ask NSI to get your personal information by writing to or contacting us using the details below. We will need to check your identity before we can give you the information. If you ask for your personal information, we will get back to you in a reasonable time (about two weeks).  

In certain circumstances, we can refuse access to your personal information. For example, when access affects the privacy of others or reveals sensitive information. If this is the case, we will explain our decision and how you can complain if you are not satisfied with the decision.

If you think your personal information is wrong, you can ask us to correct it. We will try our best to fix it. We will explain why in writing if we can’t correct your personal information.

How can you get more information or complain about your privacy?
